THE SUPPLY, RECTIFICATION AND RECONSTITUTION OF RECORDS IN THE LIGHT OF THE ANGOLAN LEGAL ORDER

Abstract

Notary and Registry Rights are branches of the Science of Law that regulate the notarial and registry activity, and the professional who performs this function (Notary or Registrar), and that have evolved like the other branches of Law over time. Angolan law (Law No. 1/97, on the Simplification and Modernization of Land, Commercial and Notary Service Registries, Law No. 8/11, On the Legal Regime of Notaries, Law No. 6/15, on the Simplification of Birth Registration , and others), the development of jurisprudence and specialized doctrine and the emergence of institutes, academies and institutions for the study and teaching of Notary and Registry Law in Angola, confirm this reality of the evolution of these rights. With the objective of studying and understanding the different forms of filling the lack or justification, rectification and reconstitution of the records and notarial acts presented by the doctrine and by the Angolan legal system; through the quantitative bibliographic and normative hermeneutic method, dissecting and examining literary works and legislation on the subject. It is of paramount importance for Angolan citizens, given the various events and questions of individuals, and comes to respond to the continuous need to know how and/or if a certain act of registration or notary is correctable for lack, is rectified and/or it is reconstitutable. The object of the registration is the legal fact and legal reality to which the law imposes its registration as a condition to be able to be invoked before third parties and attribute value of proof.
